IRS Describes Employment Tax Refund Process for Same-Sex Spouse Coverage

In response to the U.S. Supreme Court decision that struck down a key portion of the federal Defense of Marriage Act (DOMA), the Internal Revenue Service (IRS) has issued guidance on employment tax (FICA) refunds to employees and employers for employer-provided health coverage supplied in the past to an employee’s same-sex spouse.
